Representative Matters:

  • Won an arbitration victory for a confidential hedge fund in connection with dispute over earn-out payments relating to real estate contract.
  • Won an arbitration victory for a reinsurer in connection with nine-figure dispute over the coverage available under a reinsurance policy that reinsured batch-insurance policies issued to an automobile manufacturer by its captive insurer.
  • Won one of the largest investor arbitration awards on record for Rosen Capital after a two-week merits hearing.
  • Won an arbitration defense victory awarding claimant $0 in a confidential arbitration concerning expropriation of exploration rights.
  • Won an arbitration defense victory awarding claimant $0 after an eight-day merits hearing concerning a $1 billion claim by a pipeline company arising from an alleged natural gas dedication obligation in a confidential arbitration under Texas law.
  • Won a complete arbitration victory for Limetree Bay Terminals in a bet-the-company contractual dispute concerning the terms of a nine-figure oil storage lease agreement. Following a nine-day hearing dominated by complex fact and expert testimony concerning technical engineering concepts, the three-arbitrator panel ruled in Limetree’s favor, ordering the adversary to specifically perform the agreement and to pay Limetree damages. Deployed expertise with oil storage operations and technical compliance requirements for oil storage facilities in connection with the dispute.
  • Successfully represented FirstEnergy Generation LLC in confidential arbitrations and related federal litigation concerning several long-term coal transportation contracts with three national railroads. Deployed deep expertise with environmental regulation impacting coal- and gas-fired generation as well as the operation, efficiencies, and costs of various pollution control devices. The matter settled favorably.
