The Financial Times Agenda spoke with Elsberg Baker & Maruri PLLC partner David Elsberg on the newly launched Texas Business Court.
“The Delaware Chancery Court has had many decades to build its wealth of precedent and its track record of adhering to that precedent," Elsberg said. The same depth and breadth of corporate law precedent can’t be "replicated in another court overnight."
It will be "very difficult for Texas to displace Delaware any time soon, because having superb judges is not enough. There's just no shortcut."
